Police said Kevin Brown, 21, of Depew was attempting to elude a Creek County deputy Friday when he lost control of his sport utility vehicle.
His daughter, Paige Brown, was partially thrown from the vehicle and died Sunday in a Tulsa hospital from injuries sustained in the accident.
Pamela Hammers, assistant district attorney for Creek County, said prosecutors are awaiting the results of a toxicology test from the Oklahoma State Bureau of Investigation before they decide what charges to file in the case.
Possible charges range from second-degree manslaughter to second-degree murder, Hammers said.Hammers said officers believe Paige Brown was in a child seat, but the restraint was not fastened.
A Creek County deputy spotted Kevin Brown just after 10 p.m. on State Highway 66, west of Kelleyville. The deputy said Brown was speeding and left of center.
After being spotted, Brown attempted to escape the officer by turning off the highway onto a secondary road, losing control of the vehicle. The vehicle flipped onto its passenger side and slid off the road, uprooting several trees.
Kevin Brown and his wife, Stephanie, were not injured. Their 2-year-old son was treated and released from a Tulsa hospital.
